Terms of Use and Membership

Society for the Promotion of Applied Research in Canine Science (“SPARCS”) is a Washington non-profit corporation (“SPARCS”). These terms of use and membership (“Terms”) govern the terms and conditions for the use of this site (the “Site”) and membership in SPARCS. By using the Services (defined below), making a donation or becoming a Member (defined below), you agree to comply with and be legally bound by these Terms.

Please review these Terms carefully. If you do not agree to these Terms, you have no right to continue using the Services or to become a Member of SPARCS. We reserve the right to modify these Terms or policies relating to the Services or membership at any time (on a prospective basis), effective upon posting of an updated version of these Terms on the Site.

Site Services

The Site is provided for users and Members to learn about SPARCS, review information on canine science, related research and any other Site Content (defined below), participate in any linked or posted surveys or questionnaires, purchase tickets to SPARCS’ conferences and other events, register with SPARCS, make donations to SPARCS, and any other services that may be offered on the Site from time to time (together, the “Services”).

Becoming a SPARCS Member

By registering a SPARCS’ user account through the Site and making a “Silver” or “Gold” level donation to SPARCS, you are agreeing to become of member of SPARCS (a “Member”) subject to these Terms. Each donation is being made as a gratuity and not expressly in exchange for the benefits offered to different levels of Members. SPARCS is not a federal non-profit organization at this time and any donations and not tax deductible. Membership with SPARCS does not confer any rights as “member” under the provisions of the Washington nonprofit corporation act, RCW 24.03.

Member Registration

In order to become a Member of SPARCS and make any donations, you must first register an account through the Site, by entering a user name, log-in and a verified email address. You may also add other personal information to your account profile as provided. You agree to promptly update all user account information if it changes. By registering with SPARCS and creating an account, you represent and warrant that you are lawfully able to enter into contracts on behalf of yourself or the entity you represent (if applicable). You are responsible for all activities associated with your account, including any donations. You must take reasonable precautions to prevent unauthorized use of your account and notify us immediately of any unauthorized use of your account. You may not provide your account login credential information to any third-party or otherwise allow any other person to use your Member account to access the Site to view any Site Content, including Videos or other Site Content restricted to Members.

Member Registration

In order to become a Member of SPARCS and make any donations, you must first register an account through the Site, by entering a user name, log-in and a verified email address. Benefits of Membership

We currently offer the following benefits to each Member according to the level of such Member’s donation to SPARCS:

    • Silver Level: For a donation at the “Silver” level, we offer each Member: (i) unlimited streaming of all Videos in the Site archive; and (ii) 10% off purchases from Dogwise Publishing.
    • Gold Level: For a donation at the “Gold” level, we offer each Member: (i) one free full conference pass to the SPARCS’ annual conference; (ii) 10% off purchases from Dogwise Publishing; and (iii) unlimited streaming of all Videos in the Site archive.

Member benefits are provided for one-year from the time of donation. Each membership must be current to receive the listed benefits. SPARCS makes no warranties regarding the continued availability of any Member benefits. All discounts with our business partners (e.g. Dogwise Publishing) are contingent on continuation of our relationship with such business partner and may be withdrawn without notice to Members. All streaming video or broadcasts of the SPARCS annual conference will be made available to Silver-level or Gold-level Members (as applicable) solely to the extent it is reasonably feasible. Some conferences or events may make it impractical to provide a live stream, due to either technological or financial constraints. Live streaming of certain videos in our Site library may be limited due to copyright or contractual limitations. There is no guarantee that live streaming will be available without interruption or periods of down time.

Refunds of Donations

All donations to SPARCS are non-refundable. The failure or inability of SPARCS to hold an annual SPARCS conference, make any content (including live streams) available or otherwise fail to provide any of the Member benefits listed above shall not entitle a Member to a refund of any donation.

Cancellation of Membership

SPARCS reserves the right to cancel the membership of any Member for a violation of these Terms. Members are not entitled to a refund of their donation for any cancellation of their membership.

Posted Video

From time to time, we may link to or post videos on the Site on topics that we believe are relevant to SPARCS’ objectives, including live streams of a SPARCS’ conference or other event (the “Videos”). The Videos are provided for information purposes only and SPARCS is not responsible for the accuracy of any of the information contained in such Videos or the usefulness or safety of any dog training or techniques that may be displayed or discussed.

Site Content

All material and content available on the on the Site (the “Site Content”) is the property of SPARCS, its affiliates or licensors, or is otherwise being displayed by SPARCS with the permission of its owner and is protected by copyright, trademark, rights of publicity and other intellectual property laws, as applicable. A lot of time and effort went into creating the Site Content, and except for the rights expressly granted in these Terms, you have no right to reproduce, copy, modify, distribute, display, or create derivative works from any of the Site Content. This prohibition includes embedding any live streaming video provided on the Site on another website or using any video capturing technologies to record or download any such live stream.

Sharing and Permitted Uses of Site Content

You may share, like, or tweet any Site Content as permitted by Site’s normal built-in features. Additionally, you may also link to the Site and use limited portions of Site Content for commentary and criticism (fair use) and especially to engage in discussion of canine science and dog behavior (Yeah!). You may not, however, reproduce, copy, modify, distribute, display, or create derivative works from any Site Content (including Site Content obtained by manually copying or through the use of bots, crawlers, or spiders, or otherwise) for any other purpose, whether or not a commercial use.

If you want to use any portion of the Site Content for some purpose not allowed by these Terms, feel free to ask us for permission. Contact SPARCS at contact@sparcsinitiative.org.

Copyright Notice

If you believe you own the right to any Site Content, believe our use of such content is infringing on your intellectual property or other rights and want the content taken off of the Site, please send us notice of the alleged infringement with a brief explanation to contact@sparcsinitiative.org and we will promptly evaluate your claim and take any appropriate action.

Third-Party Websites / Information

The Site includes links to third-party web sites that are not affiliated with SPARCS. SPARCS is not responsible the quality, content, nature or reliability of third party websites accessible by link from the Site (including ticket selling agents), or websites linking to the Site. Third party websites are not within the control of SPARCS. SPARCS will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by any third party website or the products or services offered on such site.

Ticketing Agents and Payment Processors

This Site may include links to third-party ticketing agents (e.g. Purplepass.com) (“Ticket Agents”), who may be acting as a ticket agent for SPARCS’ annual conference or other SPARCS’ events and payment processors (e.g. Stripe) (“Payment Processor”), who may process any credit card or other billing information in connection with any purchase or donation made through the Site. SPARCS is not responsible for the policies and practices of any Ticket Agent or Payment Processor (including the security of your credit card information). You are advised to read any Ticket Agent’s or Payment Processor’s terms of use and privacy policy prior to engaging in any transaction with them. SPARCS will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your transaction with a Ticket Agent or Payment Processor.

Rules and Policies for Conferences & Events

In addition to any other rules and policies required for attendance at any live SPARCS’ conference or event, the following rules and policies apply to your purchase of tickets and attendance:

  • Photography and audio or video recording of any portion of a conference or event is prohibited.
  • All tickets sales to the conferences and events are final and non-refundable. In the event a conference or event is cancelled by SPARCS, you may be entitled to a refund of the ticket price (minus ticket processing service charges of the ticket agent (e.g. Purplepass), credit card processors, or other third-parties). All tickets purchased through a Ticket Agent must comply with the ticket agent’s refund rules and procedures posted on its web site in order to be eligible for a refund. No other refunds will be made.
  • There may be dogs (that may be unleashed and unsupervised) at various times throughout conferences or events. Attendees may not bring their own dog to conferences or events, except for service animals.
  • By attending a conference or event, you acknowledge and understand the risks of injury to your person or damage or loss of your property from theft, dogs or other persons. Except as may be caused by SPARCS’ sole gross negligence, SPARCS is not liable for any such injury, damage or loss to your person or property arising out of or related to your attendance (or the cancellation of) the conference or event.
  • By attending a conference or event you acknowledge and understand that portions of the conference or event are being photographed and recorded and that you may appear in such photographs or audio/visual recordings.

Limitation on Liability

Any Site Content related to dog training methods, techniques or practices and/or canine science and dog behavior generally is provided on the Site for informational purposes only. We are not responsible for any losses, damages, claims or obligations of any nature whatsoever arising from or related to attempts by you or others to follow or put into practice any such dog training methods, techniques or practices or information regarding canine science and dog behavior generally that may be contained with the Site Content.

SPARCS IS NOT BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INCIDENTAL, GENERAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES) EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM OR RELATING TO: (A) THE USE OR INABILITY TO USE OUR SERVICES OR RECEIPT OR FAILURE TO RECEIVE ANY MEMBER BENEFITS; (B) HARM OR DAMAGE TO YOUR PROPERTY AS A RESULT OF USING OUR SERVICES OR SPARCS MEMBERSHIP; OR (C) STATEMENTS, CONDUCT OR ERRORS AND OMISSIONS IN THE SITE CONTENT OR THIRD-PARTY CONTENT.

No Warranties on Services, Site or Membership

YOU UNDERSTAND AND AGREE THAT THE SERVICES, THE SITE AND MEMBER BENEFITS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU EXPRESSLY AGREE THAT USE OF THE SERVICES AND THE SITE AND ANY DONATION IN EXCHANGE FOR MEMBER BENEFITS IS DONE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMISSIBLE UNDER THE APPLICABLE LAW, PPL AND ITS AFFILIATES DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF TITLE, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold SPARCS harmless, its officers, directors, employees and agents (including SPARCS volunteers), from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorneys’ fees) arising from your use of and access to the Service and your violation of any term of these Terms.

Privacy Statement

As part of these Terms, we are providing you information regarding the privacy policies of the Site, which may be updated from time to time without notice. SPARCS undertakes to use and protect the private personal information of users of the Site and Members consistent with these Terms and otherwise as reasonably necessary to provide the Services, maintain Members’ accounts and accept donations. SPARCS has no control over, and is not responsible for, the privacy practices of third-party web sites linked to by the Site. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with personal Information without their consent, he or she should contact us at contact@sparcsinitiative.org. If we become aware that a child under 13 has provided us with personal information, we will delete such information from our files. From time to time, SPARCS may directly ask users to participate in a survey or questionnaire, but participation is optional and the information collected will be used as stated in the survey or questionnaire.

Privacy and Use of Cookies

In order to facilitate providing the Services and the functionality of the Site, we use “cookies” (a small data file transferred to your computer for record-keeping purposes) for two purposes. First, we use “session cookies” while you are visiting the Site, which are deleted when you log-off from the Site and close your browser. We also use “persistent cookies” to save your login and password for future logins to the Site. You can instruct your browser to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site.

Members’ Personal Information

By becoming a Member and registering with SPARCS, you agree to allow us to retain all personal or other information that may be required at the time of registration as well as other information you choose to provide in maintaining your SPARCS account. SPARCS will not sell your information to any third-party. SPARCS may use this information to contact Members with offers, marketing and promotional material or other information that SPARCS feels a Member may be interested in receiving. At any time, if you wish to opt-out of receiving any further direct contact from SPARCS, you may email us at contact@sparcsinitiative.org or the online contact form on the Site.

Security

SPARCS maintains all records and each Member’s personal information in a non-encrypted password protected third-party online file storage system. While SPARCS uses reasonable methods to limit access to and protect Members’ accounts and personal information, SPARCS cannot guarantee and does not warrant the security of any Member’s information, including as a result of security breaches of our third-party data storage service providers. SPARCS shall not be liable for any breach of security that results in a Member’s personal information being disseminated or otherwise made publically available. SPARCS is not responsible for any information you provide to third-parties, including any Ticket Agent or Payment Processors.

Governing Law

These Terms shall be governed in accordance with the laws of the State of Washington, as they apply to agreements made and solely performed therein.
